Terms of Service

You must be at least 18 years old and capable of forming a binding contract under applicable law. By accepting these Terms you represent that you meet these requirements. If you are acting on behalf of an organisation, you represent that you have authority to bind that organisation.

Certain features require an account. You agree to provide accurate, current information and to keep your credentials confidential. You are responsible for all activity that occurs under your account. Notify us immediately at contact@lowkeyagency.com if you suspect unauthorised access.

You may use the Services only for lawful purposes and in accordance with these Terms. You agree not to:

• Violate any applicable law, regulation, or third-party rights.
• Attempt to gain unauthorised access to any part of the Services or connected systems.
• Reverse-engineer, decompile, or disassemble any software component of the Services.
• Introduce malware, viruses, or other harmful code.
• Scrape, crawl, or harvest data from the Services without our express written permission.
• Use the Services to send unsolicited communications (spam).
• Impersonate Lowkey or any third party.
• Use the Services in a manner that could impair their availability or performance for other users.

Use of any data API or scraping product is additionally subject to our Acceptable Use Policy.

Information on this website — including service descriptions, case-study results, and example outcomes — is illustrative and for general information only. It does not constitute a guarantee or warranty of specific results. Client engagements are governed by a separate written statement of work or service agreement signed by both parties; those documents supersede these Terms to the extent of any conflict.

Where the Services include paid features, prices are displayed before purchase. All amounts are in Canadian dollars unless stated otherwise. Payments are processed by Stripe, Inc. under their terms. Subscriptions renew automatically until cancelled. We reserve the right to change pricing with 30 days' notice to existing subscribers. Refund eligibility is determined by the applicable service agreement; platform subscriptions are generally non-refundable except as required by law.

The Lowkey name, logo, website content, platform design, and proprietary methodology are owned by or licensed to us and protected by copyright, trademark, and other laws. You may not reproduce, distribute, or create derivative works from our content without express written permission.

Content you upload to the Services remains yours. By uploading it you grant us a non-exclusive, royalty-free licence to store, process, and display it as necessary to provide the Services to you.

Our Privacy Policy describes how we collect and use your information. By using the Services you agree to that policy.

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL LOWKEY, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) $100 CAD.

Some jurisdictions do not allow exclusion of implied warranties or limitation of liability for certain damages. The above exclusions and limitations apply only to the fullest extent permitted by applicable law.

You agree to indemnify, defend, and hold harmless Lowkey and its affiliates from any claims, damages, costs, and expenses (including reasonable legal fees) arising from your use of the Services, your violation of these Terms, or your violation of any third-party rights.

We may suspend or terminate your access to the Services at any time, with or without cause, with reasonable notice unless your conduct poses an immediate risk. Upon termination, your right to use the Services ceases. Sections on intellectual property, disclaimers, limitation of liability, and governing law survive termination.

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You consent to the exclusive jurisdiction of the courts of Ontario for any dispute arising hereunder.

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice at the top of this page. Continued use after the effective date constitutes acceptance of the revised Terms.
